This is a RENEWED updated public records requests by the Downtown Neighbors Alliance, Inc. (DNA), pursuant to Chapter 119, all for records concerning any City negotiations, communications, correspondence, emails, calendar entries, notes, and other exchanges of information of any kind concerning any proposed Ultra Music Festival agreement (including drafts). Please use the same IT search criteria as in the previous request. This renewed request covers PRRs 19-1757, and 19-1784. It is a renewal of the request I made for the DNA on July 2, 2019.
The request covers responsive records created, received, or exchanged until the time the search is conducted. The City has not provided any updated IT records more current than those dated June 24, 2019, at 1:15 pm, which were produced on June 24. Presumably, the City will soon be providing IT files responsive to the DNA’s July 2 Renewed PRR, however at this moment we have not received them. As shown on the attached letter, we did send a check for the amount the City requested representing an estimated half of the total review fee for the IT records requested on July 2.
The deadline for any proposed agreement and resolution to be published on the agenda for July 25 is fast approaching. There are undoubtedly responsive and available records reflecting activity within the City, between the City and Ultra, and between the City and third parties. The paper records must be produced immediately, and IT records must be reviewed and provided without delay.
We will follow the City’s new fee policy but request that the City apprise us of the amount due immediately. As you know from experience, we will pay the fees as soon as we are advised of the amount. However, the law does not permit the City to delay compliance through delays in calculating and collecting fees before reviewing responsive records for exemptions.
